Last Updated: April 22, 2026 Please read these Terms before using the Youcart Platform.

These Customer Terms of Service (“Terms”) govern your access to and use of the Youcart mobile application, website, and related services (collectively, the “Youcart Platform”). By accessing or using the Youcart Platform, you agree to be bound by these Terms.

1. Definitions

“Company,” “Youcart,” “we,” “us,” or “our” refers to Youcart, a company registered in the State of New York.

“User,” “you,” or “your” refers to any individual who creates an account or uses the Youcart Platform.

“Suppliers” refers to third-party grocery stores or retailers from which Youcart purchases products.

“Shopper” refers to a Youcart representative who purchases items from Suppliers on behalf of Youcart.

“Order” refers to a request placed by a User to purchase items through the Youcart Platform.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Youcart Platform. By using the Youcart Platform, you represent that you are legally capable of entering into a binding contract.

3. Nature of Services

Youcart operates a technology platform and shopping service that enables Users to:

  • Browse grocery and retail items;
  • Place Orders for those items;
  • Receive delivery within designated residential buildings.

3.1 Reseller Status

Youcart acts solely as an independent purchaser and reseller of goods. We:

  • Purchase items from third-party Suppliers;
  • Take title to those goods;
  • Resell them to Users;
  • Package them in Youcart-branded bags.

We do not prepare food and do not modify products prior to resale. Suppliers are independent third parties and are not partners, agents, or affiliates of Youcart. Youcart sources items exclusively from its Suppliers.

4. Geographic and Building Limitations

Access to Youcart services may be restricted to specific residential buildings. Users must select their building and provide a valid apartment number at checkout. You represent that you are authorized to receive deliveries at the address provided.

5. Account Registration and Consent

To use the Youcart Platform, you must create an account and provide:

  • First name
  • Last name
  • Email address
  • Phone number

By checking the box during sign-up stating: “By creating an account, you agree to our Terms of Service and Privacy Policy,” you consent to be legally bound by these Terms. You agree to provide accurate and complete information and to keep your credentials secure.

6. Phone Verification and SMS Consent

Users may verify their phone number via:

  • SMS one-time password (OTP), or
  • Automated phone call verification.

If you choose SMS verification, you must affirmatively opt in to receive a one-time verification message before the Sign-Up button becomes active.

We use SMS solely for:

  • One-time password authentication
  • Essential transactional notifications

We do not use SMS for marketing purposes. Message and data rates may apply.

7. Privacy Policy

7.1 Information We Collect

We collect and store the following personal information:

  • First name
  • Last name
  • Email address
  • Phone number
  • Residential building selection
  • Apartment number
  • SMS verification status
  • Order history
  • Reward point balance

We do not store full payment card details. Payments are processed by Stripe (see Section 8).

7.2 How We Use Your Information

We use your information to:

  • Create and manage your account
  • Verify your identity
  • Process Orders
  • Deliver items
  • Administer rewards and coupons
  • Provide customer support
  • Send transactional communications
  • Send email marketing communications (where permitted)

We do not sell personal information to third parties.

7.3 Email Marketing

We may send promotional emails. You may unsubscribe at any time by clicking the unsubscribe link in the email.

We currently do not conduct SMS marketing.

7.4 Data Retention

We retain personal data for as long as necessary to provide services and comply with legal, tax, and accounting obligations.

8. Payments and Stripe

All payments are processed by Stripe, a third-party payment processor. By submitting payment information, you agree to Stripe’s terms and privacy policy. Youcart does not store full credit or debit card numbers.

When you place an Order:

  • A temporary authorization hold may be placed on your card.
  • Final charges are processed once your Order is finalized.

9. Taxes

Youcart collects applicable sales tax where required by law. Youcart may provide a reseller certificate to Suppliers. Suppliers may not charge sales tax to Youcart at checkout where permitted by law. Youcart is responsible for remitting collected sales taxes to appropriate tax authorities.

10. Orders and Fulfillment

Once an Order is placed:

  • It appears in the Youcart Shopper App.
  • A Youcart Shopper purchases items directly from Suppliers.
  • Suppliers provide receipts or invoices to Youcart.

Orders may only be modified or canceled based on item availability.

11. Rewards Program

11.1 Earning Points

Users earn:

  • 1 Reward Point for every $1 spent on order subtotal.
  • Points are credited after order delivery.

11.2 Redemption Value

The redemption value of points means:

  • 1 Reward Point = $0.01 discount.
  • Points may be applied at checkout.
  • Points have no cash value and are non-transferable.

Youcart may modify or terminate the Rewards Program at any time.

12. Coupons and Referrals

12.1 Coupons

Coupons must be individually granted to a User account. Coupon codes cannot be used unless assigned to that specific User.

12.2 Referral Program

Access to Youcart may require a valid referral code when:

  • A new user signs up using a referral code
  • The new user receives a specified number of discount coupons.
  • The referring user receives one discount coupon.

Youcart may modify or discontinue referral incentives at any time.

13. Account Deletion

Users may request account deletion through the Profile tab by selecting “Delete Account.”

If confirmed:

  • Personal account information will be de-identified.
  • Purchase history will be anonymized.
  • Reward points and coupons will be forfeited.

Users may not delete their account if an Order is in progress. We may retain limited data as required by law (e.g., tax or fraud prevention purposes).

14. User Conduct

You agree not to:

  • Use the Platform unlawfully
  • Provide false building or apartment information
  • Interfere with Platform functionality
  • Abuse Youcart staff or representatives

15. Limitation of Liability

To the maximum extent permitted by law, Youcart is not liable for:

  • Product availability issues at Suppliers
  • Supplier pricing errors
  • Indirect or consequential damages
  • Loss of data

Total liability shall not exceed the amount paid for the relevant Order.

16. Termination

We may suspend or terminate your account if you violate these Terms or applicable law.

17. Governing Law

These Terms shall be governed by the laws of the State of New York.

18. Changes to Terms

We may update these Terms periodically. Continued use of the Youcart Platform after changes constitutes acceptance of revised Terms.
